Estate Planning for Young Families

Patrick handles all facets of estate planning and particularly enjoys assisting young families with their estate planning needs.  As a part of this practice area, Patrick drafts and consults clients on wills, trusts, powers of attorney, and medical directives for married couples, young families, blended families and single parent families.

Foreclosures, Deeds in Lieu, Distressed Property, Deficiency Suits

Patrick frequently consults with commercial and residential borrowers and lenders on the Arizona foreclosure statutes, purchasing foreclosed property, debt acceleration, foreclosure priority, the protections afforded by the Arizona anti-deficiency law, loss mitigation isues, and the ramifications of loan work outs, deeds in lieu of foreclosures, and short sales. In addition, Patrick counsels clients on the trustee’s sale process, the handling of judicial foreclosures, receiverships, and guarantor liability, including the liability of married persons when only one party executes loan documents. On behalf of creditors, Patrick provides counsel on obtaining prompt payments, securing claims, workouts, repossessions, and foreclosure. In addition, Patrick’s practice encompasses judgment collection and enforcement, which includes garnishments, liens, and attachments. In this regard, Patrick has recently obtained several judgments relating to commission disputes and real estate transactions. In addition, Patrick was recently retained by a large advertising company to assist in the collection of past due obligations. On behalf of debtors, Patrick provides counsel on restructuring and reorganizing debt, settlement, collateral protection, asset preservation, and renegotiating obligations.

Patrick is particularly experienced in real estate disputes and cases involving multiple sources of causation and damages and the remedies available in such disputes.

Patrick regularly represents professionals in malpractice litigation and state disciplinary hearings. In addition, Patrick frequently advises professional clients in risk reduction strategies in order to avoid investigations and lawsuits. In the past 2 years alone, Patrick has represented numerous real estate agents and brokers, architects, appraisers, directors, and officers involved in claims for negligence, misrepresentation, breach of fiduciary duty, breach of contract, liability to non-clients, and fraud.

Patrick has participated in nearly every facet of a real estate transaction, from reviewing title reports, surveys and other due diligence to permitting, financing, and disposition. Patrick has also handled the negotiation and drafting of purchase contracts, workout agreements, deeds in lieu of foreclosure, forbearance and settlement agreements, sale-lease back agreements, land contracts, easements, residential and commercial leases, property management agreements, joint-venture agreements, and loan documents throughout Arizona and nationwide. In addition, Patrick works on all types of real estate transactions, including those involving commercial office buildings, retail shopping centers, single and multi-family residences, apartment complexes, and condominiums.
